Regulation Changes to Impact Online Settlement Forms

The Government of Ontario passed a series of regulations, that came into effect on July 1, 2023, which provide for a two-year limitation period applicable to certain settlement amounts. Under this regulation, market participants can no longer submit adjustment claims for settlement amounts related to the impacted programs, more than 24 months after such amounts were invoiced or should have been invoiced. The following programs are impacted by this change:
- Limitation Periods (O. Reg. 153/23)
- Rural and Remote Electricity Rate Protection (RRRP; O. Reg. 154/23)
- Cost Recovery (O. Reg. 155/23)
- First Nations Delivery Credit (FNDC; O. Reg. 156/23)
- Distribution Rate Protection (DRP; O. Reg. 157/23)
- Ontario Electricity Support Program (OESP; O. Reg. 158/23)
- Ontario Fair Hydro Plan (OFHPA; O. Reg. 159/23)
- Ontario Rebate for Electricity Consumers (ORECA; O. Reg. 160/23)
- Global Adjustment (GA; O. Reg. 161/23)
For Local Distribution Companies submitting an adjustment claim on behalf of a customer, the regulations provide for an additional six-month period.
