Ministerial Directives

From time to time, the Minister of Energy issues directives and letters to the IESO articulating government policy.

May 30, 2017
Nagagami (Shekak) Generating Facility
This direction requires the IESO to establish and pay a hydrology adjustment to Constance Lake First Nation based on the production of the 19 megawatt Nagagami (Shekak) hydro-electric generating facility. The agreement between Constance Lake First Nation and the IESO will include the provision of a minimum annual hydrology adjustment, as well as an escalation clause to align with the Consumer Price Index (CPI) for Ontario.

Non-Utility Generators (NUGs) under Contract with the Ontario Electricity Financial Corporation (OEFC), Feed-in Tariff (FIT) Procurements, 2015-2020 Conservation First Framework, and Delivery of Programs under the Conservation First Framework and the Industrial Accelerator Program
Pursuant to this directive, the IESO will enter into negotiations with OEFC NUGs to incentivize facilities to operate in a manner better aligned with system needs. The directive amends the FIT 5 procurement target and directs the IESO to cease accepting applications under the FIT Program by December 31, 2016. The IESO is directed to use the Conservation Fund to support Ontario Energy Board pilot projects for new pricing models and non-price tools. The IESO shall also deliver certain Province-Wide Distributor CDM Programs and shall undertake a pay-for-performance pilot program under the Industrial Accelerator Program.

IESO 2017-2019 Business Plan
The Minister has asked the IESO to include resourcing for the Market Renewal project in its 2017-2019 Business Plan and resubmit it to the Minister by February 1, 2017.

On March 21, 2017, the Minister of Energy approved the IESO’s 2017-2019 Business Plan.

Ontario Quebec Electricity Trade
This direction calls for the IESO to negotiate and enter into one or more contractual agreements in accordance with the September 11, 2015, Memorandum of Understanding, which contemplated a medium-term electricity trade agreement between Ontario and Québec.

Directive from the Minister regarding LRP II RFQ Process and EFWSOP Cancellation
This directive calls for the IESO to suspend the LRP II and Energy-from-Waste procurements.

Letter from the Minister on the IESO Technical Report
The IESO has received a letter from the Minister requesting that the IESO submit, by September 1, 2016, a technical report that will provide a
10-year review and a 20-year forecast of the electricity system.

Upgrades to Existing Renewable Projects, Conservation First Framework and Support Programs

The IESO has received direction with respect to LRP II procurement, the design and delivery of CDM programs under the ongoing Conservation First Framework, as well as funding for Support Programs.

Future Renewable Energy Procurement
The IESO has received direction regarding the fuel source procurement targets and engagement process for the next round of the Large Renewable Procurement (LRP II). The Minister has also outlined details regarding the transition of the microFIT Program to a net metering initiative, as well as a base target and application window for the FIT 5 procurement.

Non-Utility Generator Projects, Combined Heat and Power Standard Offer Program 2.0, Chaudre Falls Hydroelectric Generation and Whitesand First Nation Biomass Cogeneration
Pursuant to this directive, as the IESO works to develop a capacity auction for Ontario, negotiations for new contracts for Non-Utility Generator Project (NUGs) will be discontinued and the second application window for the Combined Heat and Power Standard Offer Program 2.0 will not proceed. Further, the IESO will enter into negotiations with Hydro Ottawa Holding Inc. (HOHI) for power purchase agreements for supply from HOHI's Gatineau and Hull facilities. As well, the IESO is directed to enter into a power purchase agreement for electricity produced by Whitesand First Nation's biomass facility.

Amended and Restated Bruce Power Refurbishment Implementation Agreement and Amended and Restated Bruce Power Sharing in Transfers and Refinancings Agreement and IESO-OPG Agreement
The IESO is directed to enter into an amended agreement for the continued operation of the eight nuclear generating units at the Bruce Nuclear Generation Station beyond their current expected end of life through a program of refurbishments and asset management, as approved by Cabinet.

Conservation and Demand Management (CDM) Programs
This directive authorizes the IESO to make performance incentive payments to eligible distributors relating to IESO-Contracted Province-Wide CDM Programs delivered under the 2011-2014 Conservation and Demand Management Framework.

Feed-in Tariff Program
Under this directive, the IESO will reassign any portion of the 2015 microFIT Program procurement target that is unused by December 31, 2015, to the FIT 4 procurement target. Further, any unused capacity in future years for either FIT or microFIT will be moved to the subsequent FIT target.

Procurements
This directive calls for the IESO to negotiate and enter into a seasonal capacity sharing agreement with HQ Energy Marketing Inc. by June 1, 2015. As well, further direction is provided with respect to a number of ongoing procurements by the IESO including CHPSOP, NUGs, LRP and energy storage.

Moving forward with a new Energy-from-Waste (EFW) Procurement Process
Under this directive, the IESO will develop a procurement process for municipal projects that use waste to generate electricity. This new process will be in place by the end of 2015 and will secure up to 75 MW for new-build projects.

Feed-in Tariff (FIT) and microFIT Programs
This Directive revises current provisions regarding the FIT and microFIT programs – including allowing applicants to voluntarily select a lower base FIT contract price in order to receive additional priority points.
